Pursuant to the judgment of the Desnianskyi district court of Chernihiv in the case initiated by the civil activists, the City Council of Semenivka published the General plan of city development on its official web-site.
As early as this summer the City Council of Semenivka refused the request by Chernihiv public committee on human rights protection to provide for review the general plan of city development. In refusing access to the document the local authorities relied on the allegedly restricted information in the plan.
Civic activists appealed against the actions of City Council officials through court. Having considered the case, Desnianskyi district court of Chernihiv obliged the local authority to provide public access to the document. However the City Council executed the judgment of the court only after the court enforcement proceedings were initiated. In its resolution the State Enforcement Service obliged the local authority to publish the General plan of city development on its official website and in an accessible room of the City Council till the end of August 2014. Also the City Council was obliged to provide a copy of the document to the representatives of Chernihiv public committee on human rights protection.
The implementation of the court enforcement proceedings was started by the local authority only recently.
"I am glad that at least under constraint, but the City Council began to carry out the court judgment. However there are flaws to their performance. The City Council uploaded the master plan to its web-site in archive format at 500 Megabytes size. In the small cities, where it is problematic to have high quality Internet, the uploading of such an archive is impossible. Despite the State Enfrocement Service's resolution, we still have not received a copy of the General plan of city development... But I hope that soon we will receive it. We are also planning to visit the City Council, in order to check the availability of this document in its room", - says the Head of Chernihiv public committee on human rights protection Viktor Tarasov as a comment regarding the enforcement of the judgment.
Chernihiv public committee on human rights protection conducts its activities aimed at providing the citizens with the access to general plans of city development together with the Eastern Ukrainian Center for Civic Initiatives within the framework of the Project "Through monitoring and advocacy - to judgments in court cases concerning access to public information" supported by the UNDP and Ministry of Foreign Affairs of Denmark.
